Credit card fraud is one of the biggest loss concerns in a bank. The frauds are usually performed by a group of people either using counterfeit credit cards to cheat unsuspecting merchants or in collaboration with the merchants to cheat the banks. This group of people who performed fraud is known as fraud syndicates.

Types of frauds

There are many types of frauds that have identified by the banks. To ease the efforts of fighting fraud, they are classified into various categories by their natures

1. Counterfeit cards

Counterfeit credit card transactions are one of the biggest fraud reasons in the industry. It make up about 40% of all money lost through credit card frauds. The syndicates used various methods to obtain card information to create counterfeit cards. The illegally created counterfeit cards will have all the information of the genuine credit cards in their magnetic stripes. 3. Mail order or telephone order Fraud

Mail order or telephone order fraud accounts for 10% or is the third highest fraud reason. Usually the fraud syndicates use shady telemarketers and deceptive internet sites to obtain credit card information from the genuine cardholders. In this kind of fraud, the three digits the syndicates need the security number or card verification code (CVC2) which is printed at the back of the genuine card to complete the fraud transactions.

4. Non-receipt Fraud

Non-receipt fraud occurs when the credit cards are intercepted by the syndicates when they are on the way to the cardholders which are usually by courier or registered mails. This fraud reason accounts for about 7% of the total fraud transactions.

RICO stands for the Racketeer Influenced and Corrupt Organizations Act (18 U.S.C. § 1961), a law that increases the severity of penalties for crimes performed in conjunction with organized crime. The law states that any person or group who commits any two out of a list of 35 crimes (known as racketeering activity in the U.S. Code) within a decade and can be determined to have committed them with similar results or similar intentions can be charged with racketeering.

The maximum penalties for racketeering include a fine of up to $25,000 and up to 20 years in prison in addition to the forfeiture of all business interests and gains gleaned from the criminal activity. In addition, the case can be re-tried in civil court; plaintiffs are allowed to sue for triple damages. The law covers crimes such as bribery, extortion, money laundering, counterfeiting, gambling, murder, arson, robbery, kidnapping, harboring certain illegal aliens, obstruction of justice, slavery and others.

In order to prosecute a RICO case, investigators need to establish evidence of the existence of a criminal organization. U.S. Attorneys General who pursue RICO charges can opt to seek an injunction or restraining order before trial that prevents the assets in question from being transferred and requires the defendant to put up a performance bond. This usually serves to push the defendant to plead guilty to the charges before an indictment (a formal accusation against the defendant).

RICO laws are especially effective in prosecuting those who retaliate against victims, whistleblowers or witnesses of crimes when those parties cooperate with law enforcement or an ongoing investigation. In addition, anti-SLAPP (strategic lawsuit against public participation) laws can be applied in order to stop corporations or individuals from abusing.


Racketeer Influenced and Corrupt Organizations Act (RICO), U.S. federal statute targeting organized crime and white-collar crime. Since being enacted in 1970, it has been used extensively and successfully to prosecute thousands of individuals and organizations in the United States.

Part of the Organized Crime Control Act of 1970, the Racketeer Influenced and Corrupt Organizations Act (RICO) makes it unlawful to acquire, operate, or receive income from an enterprise through a pattern of racketeering activity. Geared toward ongoing organized criminal activities, the underlying tenet of RICO is to prove and prohibit a pattern of crimes conducted through an “enterprise,” which the statute defines as “any individual, partnership, corporation, association, or other legal entity, and any union or group of individuals associated in fact although not a legal entity.”

Under RICO, it is a crime for an individual to belong to an “enterprise” that is involved in a pattern of racketeering, even if the racketeering was committed by other members. Specifically, Section 1962 of RICO prohibits “any person” from: (a) using income received from a pattern of racketeering activity or from the collection of an unlawful debt to acquire an interest in an enterprise affecting interstate commerce; (b) acquiring or maintaining through a pattern of racketeering activity or through collection of an unlawful debt an interest in an enterprise affecting interstate commerce; (c) conducting or participating in the conduct of the affairs of an enterprise affecting interstate commerce through a pattern of racketeering activity or through collection of an unlawful debt; or (d) conspiring to participate in any of these activities.

In order for an individual or organization to be convicted of racketeering under RICO, there must be proof of a “pattern” of illegal offenses, which RICO defines as the commission of at least two identified criminal offenses within a 10-year period. RICO defines racketeering in an extremely broad manner and includes many offenses that do not ordinarily violate federal statutes, such as any act or threat involving murder, kidnapping, gambling, arson, robbery, bribery, extortion, or dealing in narcotic or other dangerous drugs.

In addition, RICO lists numerous federal offenses that the statute defines as racketeering: bribery, sports bribery, counterfeiting, embezzlement from union funds, loan sharking, mail fraud, wire fraud, obstruction of justice, trafficking in contraband cigarettes, prostitution and trafficking in people, bankruptcy fraud, drug violations, and obscenity. As long as the “racketeering activity” is “chargeable” or “indictable” under an applicable criminal statute, the substantive RICO charge is available.

RICO creates offenses and penalties above and beyond those prescribed for specific criminal offenses for those involved in an ongoing illegal enterprise that engages in racketeering. The maximum criminal penalties for violating RICO include a $25,000 fine and imprisonment for 20 years. These penalties are imposed on top of the criminal penalties resulting from two or more substantive offenses that the individual or organization has committed in the 10-year period. In addition to the criminal penalties, there are forfeiture provisions requiring the violators to forfeit any business or property derived from their illegal offenses.

Alongside criminal actions, RICO permits private plaintiffs and the government to seek redress in a civil action. Indeed, perhaps the most controversial aspect of RICO is that the government can seize and confiscate what it deems to be the proceeds of crime through the civil courts. RICO allows the government or a private citizen to file a civil suit requesting the court to order the forfeiture of assets, to impose sanctions, or to provide injunctive relief against an individual or organization involved in a “pattern of racketeering.” The civil action provisions of RICO can: force a defendant to forfeit any interest in property, restrict a defendant from engaging in certain future activities or investments, or dissolve or reorganize an enterprise. These penalties were intended to address the economic roots and organizational infrastructure of ongoing criminal conspiracies.

With respect to asset forfeiture, the state can seize property without notice upon an ex parteapplication of probable cause that the property is associated with criminal activity. In this case, criminal charges need not be provided against a defendant. In contrast to criminal prosecutions, where the burden of proof is beyond a reasonable doubt, only the lesser standard of proof—a balance of probabilities—is required under the civil provisions of RICO. The attraction of this approach is that the onus of proof is shifted to the defendant, who must prove that the assets were acquired through legitimate means. Civil RICO injunctions can prohibit individuals from owning or becoming involved in certain legitimate or illegitimate businesses or activities. Moreover, if successful, the victim may be able to recoup treble damages (that is, the defendant must pay to the plaintiff three times the amount of damages, as well as legal expenses, that have been determined by the court).

Although it took some time for federal prosecutors to fully understand and incorporate RICO into their array of prosecutorial tools, the statute has been increasingly used and has realized much success. By 1990, more than 1,000 major and minor organized crime figures had been convicted and given lengthy prison sentences under RICO. It proved especially valuable in the pursuit of organized crime networks’ senior leaders who, being far removed from the individual criminal acts perpetrated by low-level members, were previously out of prosecutors’ reach.

Although the original purpose of RICO was to address organized crime, the broad wording of the RICO statute has meant that both the criminal and civil provisions of RICO have been applied to a variety of offenses and defendants and not just those typically associated with organized crime. Other RICO defendants have included antiobscenity protesters, adult video and bookstore owners, financial institutions, politicians, doctors, and law-enforcement personnel.

Court cases have also expanded the reach of RICO. In Sedima, S.P.R.L. v. Imrex Co. (1985), the U.S. Supreme Court concluded that RICO is not limited to organized crime but may be applied to legitimate commercial-enterprise businesses. The Belgian company Sedima filed an action against rival Imrex in a U.S. district court in 1982, alleging that Imrex inflated its purchase prices and costs by preparing fraudulent purchase orders and credit memos. The action was originally dismissed by the lower court on the grounds that no RICO injury occurred, and the court’s decision was upheld on appeal.

However, the Supreme Court reversed the appellate decision, considerably broadening RICO’s scope and initiating a plethora of civil and criminal suits involving legitimate companies. Following this decision, RICO was increasingly used by the government to prosecute white-collar and corporate crimes, as well as unfair trade practices, committed by legitimate companies not associated with organized-crime groups.

Hello , I am a, staff of Private Banking Services at the Bank of China (BOC). I am contacting you concerning our customer and, an investment placed under our banks management 8 years ago. I would respectfully request that you keep the contents of this mail confidential and respect the integrity of the information you come by as a result of this mail. I contacted you independently of our investigation and no one is informed of this communication. I would like to intimate you with certain facts that I believe would be of interest to you. In 2005, the subject matter; ref: bb/boc/bank/0019   came to our bank to engage in business discussions with our Private Banking Services Department. He informed us that he had a financial portfolio of 8.370 million United States Dollars, which he wished to have us turn over (invest) on his behalf. I was the officer assigned to his case; I made numerous suggestions in line with my duties as the de-facto chief operations officer of the Private Banking Services Department, especially given the volume of funds he wished to put into our bank. We met on numerous occasions prior to any investments being placed. I encouraged him to consider various growth funds with prime ratings. The favored route in my advice to customers is to start by assessing data on 6000 traditional stocks and bond managers and 2000 managers of alternative investments. Based on my advice, we spun the money around various opportunities and made attractive margins for our first months of operation, the accrued profit and interest stood at this point at over 10 million United States Dollars, this margin was not the full potential of the fund but he desired low risk guaranteed returns on investments. In mid 2006, he asked that the money be liquidated because he needed to make an urgent investment requiring cash payments in Europe. He directed that I liquidate the funds and had it deposited with a firm. I informed him that the bank would have to make special arrangements to have this done and in order not to circumvent due process, the bank would have to make a 9.5 % deduction from the funds to cater for banking and statutory charges. He complained about the charges but later came around when I explained to him the complexities of the task he was asking of us. Cash movement across borders has become especially strict since the incidents of 9/11. I contacted my affiliate in and had the funds available. I undertook all the processes and made sure I followed his precise instructions to the letter and had the funds deposited in a security consultancy firm, the firm  is a specialist private firm that accepts deposits from high net worth individuals and blue chip corporations that handle valuable products or un In January last year, we got a call from the security firm informing us that the inactivity of that particular portfolio. What constitutes fraud?

Fraud is a deliberate act of deception intended for personal gain or to cause a loss to another party. An irregularity is an act which doesn’t comply with EU rules and which has a potentially negative impact on EU financial interests, but which may be the result of genuine errors committed both by beneficiaries claiming funds and by the authorities responsible for making payments. If an irregularity is committed deliberately, however, it’s fraud.

Please report if you suspect:

  • fraud or other serious irregularities with a potentially negative impact for EU public funds, whether EU revenue, expenditure or assets held by the EU institutions.
  • serious misconduct by Members or staff of EU Institutions and bodies.

OLAF cannot investigate allegations of:

  • fraud with no financial impact on the EU public funds. Please report such allegations to the national police.
  • corruption which doesn’t involve Members or staff of EU Institutions and bodies. Please report such allegations to the national police.
  • fraudulent use of the EU logo or the name of EU institutions.

Fraud can now be reported to the Canadian Anti-Fraud Centre (CAFC) through a new, easy to use, Fraud Reporting System (FRS). You can log into the tool using either:
  • GC Key (User ID/Password)
  • Sign-In Partners (Banking Credentials)
A GCKey account or a Sign-In Partners login uses unique electronic credentials that allow you to communicate securely with the Government of Canada. This new login is a federal government mandate and all Government of Canada on-line services are to be delivered through the GCKey or Sign-In Partners, providing increased levels of privacy and security for users.

By offering a choice of credentials, the Government of Canada is making its online services more convenient and easier to use. Many individuals already use their online banking credentials regularly and being able to use these same credentials to access Government of Canada services online will simply mean one less User ID and password to remember.

 Please note: The Fraud Reporting System has a timeout feature that will log you out if there is no activity within 20 consecutive minutes. Prior to the timing out, the application will pop-up a message asking you to reset your session. If you timed out, you will be logged out of the application. No data will be lost but you will not be able to log back into the application to complete your complaint. If you require additional information to be added to your complaint, please contact the Canadian Anti-Fraud Centre for further assistance.

GCKey is a service provided by the Government of Canada that allows you to securely conduct online business with various government programs and services, including reporting fraud to the CAFC.

Sign-In Partners are organizations that have partnered with SecureKey Technologies to enable their customers to use their online credentials, such as card numbers or user names and passwords, to access Government of Canada services. Currently there are five Sign-In Partners: BMO Financial Group, CHOICE REWARDS MasterCard , Tangerine, Scotiabank and TD Bank Group. Banking information is not shared when you use a Sign-In Partner.

The technology is designed in such a way that the Government of Canada will not know which Sign-In Partner (or financial institution) you have used. Similarly, the bank will not know which government department or agency its customer contacted.
